    1. Acceptance of Terms

    By accessing or using Wanderly's website and services at getwanderly.com (the "Service"), you confirm that you are at least 18 years old, have read and understood these Terms of Service ("Terms"), and agree to be bound by them. If you are using the Service on behalf of a business, you represent that you have authority to bind that business. If you do not agree, do not use the Service.

    2. Description of Service

    Wanderly Technologies LLC ("Wanderly", "we", "us", "our") is a California limited liability company that operates an eSIM marketplace enabling travellers to purchase and activate eSIM data plans for mobile connectivity in 200+ countries. We act as a reseller of eSIM plans provided by upstream network carriers. Zotlo (Z3P LLP) acts as our merchant of record for payment processing.

    3. Eligibility and Account

    You must be at least 18 years old to purchase from Wanderly. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

    4. Payment and Refunds

    If your purchase was processed by our reseller and merchant of record, Zotlo, all billing, cancellation, and refund matters are administered by Zotlo. You may (a) submit a cancellation or refund request at any time via https://account.zotlo.com/ by signing in with the same email address used for the purchase; (b) alternatively, contact support@zotlo.com; and (c) for general purchase, payment, cancellation, or refund inquiries please email support@zotlo.com.

    Zotlo's registered details are: Z3P LLP, 5th Floor, 86 Jermyn Street, London, SW1Y 6AW, United Kingdom. You agree that (i) Zotlo may require reasonable verification (including purchase email and transaction details) to authenticate your request; and (ii) eligibility, timing, and method of any refund are determined by Zotlo's applicable terms presented at the paywall.

    5. eSIM Delivery and Activation

    Upon successful payment, your eSIM QR code will be delivered to your registered email address. You are responsible for: (a) verifying your device is eSIM-compatible before purchase; (b) following activation instructions correctly; (c) enabling data roaming on your device as required by your carrier. We are not responsible for activation failures caused by device incompatibility, incorrect device settings, or carrier restrictions.

    6. Service Limitations and Availability

    eSIM coverage, speeds, and availability depend on local network infrastructure and are not guaranteed. We do not warrant uninterrupted service, specific download or upload speeds, latency, or network availability in any particular location. Coverage maps and plan descriptions are indicative only. We are not liable for network outages, congestion, or performance variations beyond our control.

    7. Acceptable Use

    You agree not to use the Service to: (a) violate any applicable law or regulation; (b) resell or redistribute eSIM plans without our prior written consent; (c) circumvent, disable, or interfere with security features of the Service; (d) use automated tools to scrape, harvest, or extract data from our platform; (e) impersonate any person or entity; (f) transmit harmful, offensive, or unlawful content via our platform; (g) engage in any fraudulent activity including chargeback abuse.

    8. Intellectual Property

    All content, trademarks, logos, software, and other intellectual property on our platform are owned by or licensed to Wanderly. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works of any Wanderly content without prior written permission.

    9. Third-Party Services

    Our Service integrates with third-party providers including Zotlo (payments), Supabase (infrastructure), and upstream eSIM network operators. We are not responsible for the acts, omissions, or policies of these third parties. Use of third-party services is subject to their own terms and privacy policies.

    10. Disclaimer of Warranties

    The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components.

    11. Limitation of Liability

    To the maximum extent permitted by applicable law, Wanderly's total liability to you for any claim arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or business opportunity, even if advised of the possibility of such damages.

    12. Indemnification

    You agree to indemnify, defend, and hold harmless Wanderly and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

    13. Force Majeure

    We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, internet infrastructure failures, or actions of third-party network operators.

    14. Governing Law and Dispute Resolution

    These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or relating to these Terms or the Service shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales. Nothing in this clause limits your rights as a consumer under applicable mandatory local law.

    15. Changes to Terms

    We reserve the right to modify these Terms at any time. Material changes will be communicated by email (for account holders) or by posting a prominent notice on our website at least 14 days before taking effect. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

    16. Severability and Waiver

    If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
